Corporate growth is crucial for the economic development of any country across the globe. Over the past decade, India has attempted numerous structural reforms in key areas of economic activity. The ambition behind such reforms is to smoothen the investment process and transform India into an Investor-friendly destination. One area of reform which has attracted much attention is adjudication of corporate disputes. Corporate Litigation has undergone monumental transformation since the enactment of new economic and business laws, i.e. Companies Act 2013, IBC 2016 and Competition Act 2002. The Companies Act 2013 led to the establishment of two new forums for adjudication of corporate disputes, viz. NCLT and NCLAT. As India takes major strides towards achieving its ambition, all eyes are set on these forums which would be the battlefield of major corporate disputes.
These new forums allow young Lawyers, Chartered Accountants, Company Secretaries, Cost Accountants and other professionals to pursue and carve exciting and immensely rewarding career opportunities. With new NCLT benches opening up and wide jurisdictional of these forums, covering disputes under Companies Act 2013, Insolvency and Bankruptcy Code 2016 and Competition Act 2002, mean that there would be no dearth of opportunities for the professionals to grow, financially and in experience. However, absence of procedural knowledge, weak conceptual clarity, and intimidation due to use of technical jargons and lack of confidence, often discourage talented and skillful minds from pursuing a career in corporate litigation. Remember, that corporate litigation is completely different ball game where skill and craft often value more than bookish knowledge!
This course would give the audience an in-depth understanding of litigation procedures, rules and regulations that bind these forums. All of it, in simplest vocabulary where heavy jargons would be broken into understandable units. It will equip the professional aspirants with necessary tools and knowledge concerning corporate litigations in matters and appeals arising out of Companies Act, 2013, Competition Act, 2002 and Insolvency and Bankruptcy Code, 2016. The course would allow an opportunity to understand basic concepts, major types of corporate disputes, procedural requirements, jurisdictional complexities and administration of cases involved with these forums.
